Tennessee birth records are restricted for 100 years under Tenn. Code Ann. ยง 68-3-205. Only certain parties may obtain a certified copy during that period. Eligible persons are: the person named on the certificate, a parent listed on the certificate, a spouse, an adult child of the registrant, someone with legal custody documented by a court order, or anyone who holds a notarized authorization from the person named on the record.

Historical Polk County Birth Records

Polk County was founded in 1839 and is located in the southeastern corner of Tennessee along the North Carolina and Georgia borders. Statewide birth registration in Tennessee did not begin until July 1908. Records from 1913 are missing across the whole state. Full registration compliance was not achieved until approximately 1927. In rural southeast Tennessee counties like Polk, some births in the early registration years may not have been recorded at all.

For births in Polk County that fall before 1908, you will need to use substitute sources. Census records, church records, family Bible entries, and school records can all help establish a birth. The TSLA holds birth records that are over 100 years old and has guides on substitute records for Tennessee genealogy research. Contact TSLA at 615-741-2764 or ask@tsla.libanswers.com for help with Polk County birth research in the 1800s and very early 1900s.

If a birth in Polk County was never registered, you can file for a delayed birth certificate. The application requires supporting evidence. Details on the delayed registration process are at the Tennessee Vital Records delayed certificate page.
